Terms of Use
1. Purpose
These Terms set out the conditions for using the iOS app “Chanchan” (the “App”) provided by Lumos Lab (“we” or “us”), and the rights and responsibilities of you and us.
2. What the App does
- The App shows the photos and videos in the photo library on your device one at a time and helps you decide whether to keep each one, mark it for deletion, add it to an album, or look at it later.
- It also provides sorting sessions, a Trash inside the App, statistics, widgets, notifications, and the paid features described in section 6.
- You don't need an account to use the App. We don't run servers for the App, and your photos and sorting history are stored on your device.
- We may add, change, or discontinue features. If we change paid features in a way that is unfavorable to you, we will give notice in advance as described in section 13.
3. Applicable terms
- By installing and using the App, you agree to these Terms.
- Downloading the App and making purchases on the App Store are also subject to Apple's terms. Anything Apple handles, such as payment, billing, and refunds, follows Apple's terms and policies. Section 12 sets out how these Terms relate to Apple.
- Matters not covered here are governed by applicable law and general commercial practice.
4. Photo library access
- The App needs access to your photo library. You can allow Full Access or Limited Access (selected photos only), and you can change or revoke this at any time in the Settings app.
- With Limited Access, you can only sort the photos you selected, and album features (creating albums or adding photos to them) are unavailable.
- Saving a compressed video or a converted Live Photo to your library uses the permission to add photos.
5. Deleting photos and your responsibility
- Marking a photo for deletion, by swiping or with a button, does not delete it. Marked items are collected in the App's Trash, where you can restore them at any time.
- Photos are only deleted from your library when you choose Delete on the Trash screen and then confirm again in the dialog shown by iOS.
- Deleted photos move to Recently Deleted in the Photos app and stay there for 30 days, during which you can recover them in the Photos app. After 30 days, or once you delete them from Recently Deleted yourself, they can't be recovered, and we have no way to recover them either.
- If iCloud Photos is on, deleted photos are also deleted on every device signed in to the same Apple Account.
- Video compression and Live Photo conversion save a new file to your library, and export to files saves the original to a folder you choose; the original is then moved to Trash (marked for deletion). The original is not deleted until you delete it from Trash.
- You decide what to delete. Suggestions such as the recommended photo in a group of similar photos, blur detection, and protection badges are for reference only. You are responsible for the final decision to delete and its results, and we recommend backing up important photos separately.
6. Paid products
- The App is free to download. Free users can make sorting decisions on up to a set number of photos each day; reviewing and deleting from Trash is not limited. The daily number is shown in the App.
- Unlimited sorting and certain features (similar photo groups, sessions such as trips, topics, and blurry photos, Bulk Mode, tools, album name suggestions, and others, together “Pro”) are available through these products:
- Chanchan Pro Annual: an auto-renewing subscription billed yearly. First-time subscribers may be offered a free trial.
- Chanchan Pro Lifetime: a one-time purchase that does not renew.
- Prices are those shown on the App Store purchase screen at the time of purchase and may vary by country and currency. The length of any free trial is also shown on the purchase screen.
- Payment is processed by Apple and charged to your Apple Account. We never receive your card number or other payment details.
7. Auto-renewing subscription
- Payment for the annual subscription is charged to your Apple Account when you confirm the purchase.
- The subscription renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period. If the renewal price changes, Apple will notify you in advance under its procedures.
- If you start a free trial, it converts to a paid subscription and you are charged when the trial ends, unless you cancel at least 24 hours before the trial ends. Any unused portion of a free trial is forfeited when you purchase a paid product.
- You can manage or cancel your subscription in Settings > [your name] > Subscriptions on your iPhone, or in your App Store account settings. You can also get there from the App's Settings screen.
- After you cancel, you can keep using Pro until the end of the period you've already paid for. Deleting the App does not cancel your subscription.
8. Lifetime purchase and restoring purchases
- The Lifetime purchase is paid once and is never renewed or charged again.
- “Lifetime” means the period during which we offer the App, not your lifetime. During that period, you can use Pro with the Apple Account that made the purchase, including Family Sharing members, with no time limit and no renewal charges.
- The Lifetime purchase includes the Pro features available at the time of purchase and any features later added to Pro in the same App. It may not include features that require us to run servers or services that we offer as separate products.
- If we stop offering the App, we will announce it on this website at least 30 days in advance. Where we can still update the App, we will also announce it in the App. Because the App works without our servers, you can keep using a copy that is already installed, but we don't guarantee that it will work on later versions of iOS. Any refund in connection with the App being discontinued will be handled in accordance with applicable law.
- The Lifetime purchase supports Apple Family Sharing. The annual subscription does not.
- On a new device or after reinstalling the App, use Restore Purchases in the App to bring back purchases made with the same Apple Account.
9. Cancellation and refunds
- You may cancel a purchase of a paid product within 7 days from the date of purchase.
- Once you start using Pro features after purchase, your right to cancel may be limited under applicable law. So that you can try Pro before buying, we offer free use and a free trial, and we state this on the purchase screen.
- Notwithstanding paragraphs 1 and 2, if the App does not work as displayed or advertised or as described in the contract, you may cancel within 3 months from the date you received the product, or within 30 days from the date you became aware, or could have become aware, of that fact.
- Because Apple processes payment, refunds for cancellations are requested from Apple. You can request a refund at reportaproblem.apple.com, and Apple handles it under its policies. We can't cancel or refund App Store payments ourselves.
- If you are entitled to a refund under applicable law but Apple does not provide it, please let us know using the contact details in section 15. We will take responsibility for resolving it.
- If a minor makes a purchase without the consent of a parent or legal guardian, the minor or the parent or guardian may cancel the contract, except where applicable law restricts cancellation.
- If a purchase is refunded, the Pro access it provided ends.
10. Intellectual property
- We own the rights to the software, design, text, and icons of the App and this website. You may use the App for personal purposes within the scope described in section 12. Except as permitted by law, you may not copy, modify, distribute, or reverse engineer it without our permission.
- Open-source software included in the App is subject to its own license.
- You own your photos and videos and the share images the App creates. We never receive or use them.
11. Disclaimers and limitation of liability
- We work to keep the App reliable, but we don't guarantee that it will work without errors on every device and in every environment.
- Information such as similar photos, blur, topics, place names, album name suggestions, and estimated storage is calculated automatically on your device and may be inaccurate.
- We are not liable for damage caused by deletions you carried out, by the behavior or outage of Apple services such as iOS, iCloud, or the App Store, or by the failure or loss of your device. This does not apply to damage caused by reasons attributable to us, whether intentional or negligent.
- Where the law of the country in which you reside permits it, our total liability to you is limited to the greater of the amount you paid for the App, including in-app purchases, in the 12 months before the cause of the claim arose and US$50. This limit does not apply to you if you are subject to laws, such as those of the Republic of Korea, that do not permit such a limit. Nor does it apply to damage caused by our intentional misconduct or gross negligence, or to any liability that cannot be excluded or limited by law.
- This section applies to the extent permitted by applicable law.
12. Apple-specific terms
These Terms are also the end-user license agreement for the App as obtained from the App Store. You and we acknowledge and agree to the following.
- Parties: These Terms are concluded between you and us only, and not with Apple Inc. (“Apple”). We, not Apple, are solely responsible for the App and its content. These Terms do not provide for usage rules that conflict with the Apple Media Services Terms and Conditions (the “Apple Terms”).
- Scope of license: The license we grant you is a non-transferable license to use the App on any Apple-branded products that you own or control, as permitted by the usage rules set out in the Apple Terms, except that the App may also be accessed and used by other accounts associated with the purchaser through Family Sharing or volume purchasing.
- Maintenance and support: We are solely responsible for providing any maintenance and support for the App, as specified in these Terms or as required under applicable law. Apple has no obligation whatsoever to provide any maintenance or support for the App.
- Warranty: We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are our sole responsibility.
- Product claims: We, not Apple, are responsible for addressing any claims by you or any third party relating to the App or your possession or use of the App, including but not limited to (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation. These Terms do not limit our liability to you beyond what is permitted by applicable law.
- Intellectual property claims: If any third party claims that the App or your possession and use of the App infringes that third party's intellectual property rights, we, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of that claim.
- Legal compliance: You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
- Developer contact: Questions, complaints, or claims about the App should be directed to our name, address, telephone number, and email address listed in section 15.
- Third-party terms: You must comply with any applicable third-party terms of agreement when using the App, such as the terms of your wireless data service.
- Third-party beneficiary: Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
13. Changes to these Terms
- We may change these Terms to the extent permitted by law.
- When we do, we will post the changes and their effective date on this website at least 7 days before they take effect, or at least 30 days before if the changes are unfavorable to you.
- If you don't agree to the changes, you can stop using the App and cancel your subscription. If you keep using the App after the effective date, you are considered to have agreed to the updated Terms.
14. Governing law and jurisdiction
- These Terms are governed by the laws of the Republic of Korea. Any dispute between you and us about the App will be resolved in the court that has jurisdiction under the Korean Civil Procedure Act.
- Regardless of this section, you keep the protection of any mandatory consumer protection laws of the country in which you reside.
